1. Acceptance of Terms

By using SwingVantage, you agree to these Terms of Service. If you do not agree, please do not use SwingVantage.

2. What SwingVantage Is

SwingVantage is an AI-powered swing analysis tool for educational and improvement purposes. It is not a substitute for:

• Certified sports coaching or instruction
• Medical or physical therapy advice
• Professional athletic training supervision
• Biomechanical laboratory measurement

SwingVantage provides heuristic analysis and educational information. Results are estimates and should not be treated as definitive measurements. SwingVantage does not guarantee any specific athletic outcome, score improvement, or competitive result.

3. AI Disclaimer

SwingVantage uses artificial intelligence and deterministic engines to analyze swing patterns. AI outputs may be inaccurate, incomplete, or not applicable to your specific situation. Always exercise independent judgment and consult qualified professionals for safety-critical decisions.

4. User Responsibilities

• You are responsible for your own physical safety when practicing any drills or techniques suggested by SwingVantage
• Minors (under 18) should train under adult supervision
• Do not rely on SwingVantage as your only source of coaching if injury risk is a concern
• Do not upload videos of others without their consent
• Do not upload videos of minors without parent/guardian consent

5. Intellectual Property

SwingVantage's software, deterministic analysis engine and its outputs, scoring weights, fault taxonomies, benchmarks, drill libraries, AI prompts, and content are proprietary and confidential. You may not copy, reverse-engineer, decompile, or redistribute SwingVantage's systems or analysis outputs without written permission. Our content and analysis results are fingerprinted, so unauthorized copies are traceable. See our LICENSE file for details.

6. Limitation of Liability

SwingVantage is provided “as is” without warranty. To the maximum extent permitted by law, SwingVantage is not liable for injury, loss, or damage arising from use of the platform or reliance on its analysis results.

7. Your Content & License to Operate

You keep ownership of the videos, data, and other content you upload (“Your Content”). To run the service for you, you grant SwingVantage a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display back to you, and transmit Your Content solely to operate, secure, and improve the features you use — including sending a small sample of swing frames to a third-party AI provider for analysis, as described in our Privacy Policy.

This license is revocable: it ends for a piece of content when you delete it (subject to short, routine backup retention) and ends for all of Your Content when you delete your account. We do not sell Your Content, and we do not use it to train shared AI models without your explicit consent. You are responsible for having the rights to upload Your Content, including the consent of anyone shown in it (see Section 4).

8. Acceptable Use

To keep SwingVantage safe and lawful, you agree not to:

• Upload content you do not have the right to share, or that shows a person (including a minor) without the required consent
• Upload unlawful, harmful, harassing, or infringing content
• Attempt to access other users' data or our admin / internal systems
• Probe, scan, or attempt to breach security — responsible disclosure is welcome via our Vulnerability Disclosure page
• Scrape, harvest, or use automated means to access the service, or bulk-extract its analysis outputs, benchmarks, drills, or content, except as expressly permitted
• Send automated requests beyond the posted rate limits, or circumvent (or attempt to circumvent) rate limiting, bot protection, or other technical protection measures
• Reverse-engineer, decompile, resell, or redistribute the service or its outputs, or misuse AI features to generate unlawful or deceptive content

We may suspend or terminate accounts that violate these terms, and — where our fingerprinted content or analysis outputs have been copied — pursue takedowns and other remedies.

9. Subscriptions, Billing & Cancellation

SwingVantage offers free and paid plans. Paid plans are billed in advance through our third-party payment processor on a recurring basis (monthly or annual) and renew automatically until you cancel. You can cancel anytime from your account settings or by contacting us; cancellation stops future renewals, and paid features remain active until the end of the current billing period. Prices and plan features may change with reasonable notice.

Deleting your account does not by itself cancel an active subscription — please cancel billing separately.

Refunds & free trials. Any free-trial length and the price you pay are shown at checkout before you confirm. If you believe you were charged in error, email support@swingvantage.com and we will review it. Our detailed refund and free-trial terms are being finalized and will appear here before paid plans launch.

10. Governing Law, Changes & Termination

We may update these Terms as the product evolves; material changes are reflected by updating the effective date above and, where appropriate, by notice in the app. Continued use after an update means you accept the revised Terms. We may suspend or end access for violations of these Terms or to comply with law.

Governing law & disputes. The specific governing law, jurisdiction, and dispute-resolution process will be set out here before SwingVantage launches commercially. In the meantime, if you have a dispute or concern, please contact us first at support@swingvantage.com so we can try to resolve it directly.
